Ohio law made it a crime for a physician to perform an abortion on an unmarried, unemancipated, minor woman unless one parent is notified or a court authorizes the abortion on the minor's showing that she is sufficiently mature to make the decision herself; that she has been physically, emotionally, or sexually abused by one parent; or that notice is not in her best interests. The plaintiffs, an abortion facility, a doctor, and a minor seeking an abortion, challenged the statute's constitutionality. The U.S. Supreme Court held that because the statute's notice provisions satisfied Bellotti's four criteria, and because no evidence showed that the statute's new provisions would be ignored, the statute was not facially unconstitutional. Further, the Court held that the statute's heightened standard of proof and possibly confusing formal requirements survived scrutiny because the statute provided the minor with an attorney and a guardian ad litem.
